These Terms and Conditions apply to private tours, customized itineraries, and related travel services booked through Moroccos.Tours.

Please read them carefully before confirming your booking. Your accepted quotation, final itinerary, booking confirmation, and these terms and conditions together form the agreement between you and Moroccos.Tours.

1. About Moroccos.Tours

In these Terms, “Moroccos.Tours,” “we,” “us” and “our” refer to the legal company identified above.

“You,” “traveler,” “customer” and “lead traveler” refer to the person making the booking and, where applicable, every person included in that booking.

2. Our Role

When a private tour or customized itinerary is sold and confirmed under the Moroccos.Tours name, Moroccos.Tours is responsible for planning and coordinating the services expressly listed in the accepted quotation and booking confirmation.

Depending on your confirmed itinerary, our responsibilities may include:

  • Designing and confirming the agreed route
  • Coordinating private transport and transfers
  • Reserving the agreed accommodation
  • Arranging licensed local guides
  • Confirming desert camps and activities
  • Collecting the payments stated in the quotation
  • Issuing booking documents
  • Providing assistance with the confirmed arrangements

Only the services expressly listed in your final written quotation and booking confirmation form part of your booking.

Information displayed on the website, sample itineraries, and preliminary proposals are provided for general planning purposes and do not create a confirmed booking.

3. Independent Service Providers

Parts of your journey may be performed by independent professional suppliers, including:

  • Transport companies and drivers
  • Hotels, riads and guesthouses
  • Desert camps
  • Licensed city and mountain guides
  • Restaurants
  • Activity providers
  • Ferry companies or airlines, when expressly included
  • Other tourism-service providers

Moroccos.Tours selects and coordinates these suppliers for the services included in your confirmed itinerary.

Each supplier is responsible for performing its own service in accordance with applicable law, professional requirements, and the confirmed arrangements. The use of an independent supplier does not remove any responsibility that Moroccos.Tours has expressly accepted or that cannot legally be excluded.

4. Intermediary-Only Services

In limited circumstances, Moroccos.Tours may assist with a standalone service that is not part of a Moroccos.Tours tour, such as an independent hotel reservation, flight, insurance policy or activity supplied directly by another company.

When Moroccos.Tours acts only as an intermediary:

  • This role will be explained before confirmation
  • The responsible provider will be identified
  • The provider’s own booking conditions may apply
  • Your contract for that service may be directly with the provider

A service will not be described as an intermediary-only booking when it forms part of a complete itinerary sold and confirmed by Moroccos.Tours under its own name.

5. The Lead Traveler

The person making the booking is considered the lead traveler.

The lead traveler confirms that they:

  • Are at least 18 years old
  • Have authority to make the booking for every traveler listed
  • Have provided accurate information about all travelers
  • Have shared these terms and the booking information with the group
  • Are authorized to accept the itinerary and quotation
  • Are responsible for making the required payments

All communication sent to the lead traveler is considered to have been communicated to the travelers included in the booking.

The lead traveler must promptly inform us of any changes to names, contact details, travel arrangements, or other information relevant to the booking.

6. Quotations and Availability

A quotation is based on:

  • The information supplied by the traveler
  • The requested travel dates
  • The number of travelers
  • The proposed route
  • Accommodation availability
  • Room arrangements
  • Transport requirements
  • Requested activities
  • Supplier prices and conditions
  • The currency and exchange rate used when the quotation is prepared

Unless otherwise stated, a quotation is not a confirmed reservation and remains subject to availability.

A quotation may have an expiry date. If no expiry date is shown, please contact us before making payment to confirm that the services and price remain available.

We may revise a quotation before confirmation when:

  • Availability has changed
  • A supplier has changed its price
  • The number of travelers has changed
  • The itinerary has been modified
  • A mistake has been identified
  • Taxes, entrance charges, or mandatory fees have changed

We will explain any material revision before asking you to confirm the booking.

7. Formation of the Booking Contract

A booking becomes confirmed when:

  1. You accept the final written quotation and itinerary;
  2. We confirm that the principal services are available;
  3. We receive the required deposit or full payment, and
  4. We issue a written booking confirmation.

An inquiry, website form, WhatsApp message, draft itinerary, or preliminary quotation does not by itself create a confirmed booking.

Your contract consists of:

  • The accepted quotation
  • The final confirmed itinerary
  • The booking confirmation
  • These Terms and Conditions
  • Any additional written conditions disclosed before payment

If a special supplier condition applies to a specific service, it should be identified in the quotation or booking confirmation.

8. Prices

Unless otherwise stated, tour prices are based on the number of travelers and room arrangements shown in the quotation.

Your quotation should specify:

  • Whether the price is per person or per group
  • The currency
  • The accommodation category
  • The included meals
  • The transport arrangements
  • The guided visits
  • The included activities
  • The excluded services
  • Any single-room supplement
  • Any child rate
  • Any optional upgrade

Prices do not include services or expenses that are not expressly listed as included.

Typical exclusions may include:

  • International flights
  • Travel insurance
  • Visa or passport costs
  • Meals not listed as included
  • Drinks
  • Personal purchases
  • Optional activities
  • Tips
  • Unspecified entrance fees
  • Additional services requested during the trip

9. Payments

The required deposit, balance-payment date, accepted payment methods, and payment currency will be stated in your quotation or booking confirmation.

Your booking is not confirmed until the required payment has been received and we have issued written confirmation.

You are responsible for:

  • Bank-transfer charges
  • Card-processing charges disclosed before payment
  • Charges imposed by your bank
  • Currency-conversion costs
  • Ensuring that the full required amount reaches Moroccos.Tours

If the balance is not paid by the stated deadline, we may treat the booking as cancelled by the traveler after sending a written payment reminder. The applicable traveler-cancellation conditions may then apply.

Do not send payment to an account that has not been confirmed through an official Moroccos.Tours communication channel. Contact us immediately if you receive an unexpected request to pay a different person, account, or company.

10. Accuracy of Traveler Information

You must check the booking confirmation and inform us immediately if any information is incorrect.

Names provided for flights, ferries, or other ticketed services must match the traveler’s passport or official travel document.

Moroccos.Tours is not responsible for costs resulting from incorrect information supplied by the traveler, including:

  • Incorrect names
  • Incorrect travel dates
  • Incorrect flight information
  • Incorrect passport details
  • Incorrect room requirements
  • Undisclosed mobility or health requirements

Corrections may be subject to supplier charges and availability.

11. Passports, Visas, and Entry Requirements

Each traveler is responsible for obtaining and carrying:

  • A valid passport
  • Any required visa
  • Transit authorization
  • Vaccination or health documentation
  • Travel permission for children
  • Any other required entry or exit document

We may provide general travel information, but entry requirements can change and depend on nationality, residence, transit route, and personal circumstances.

Travelers should verify current requirements with the relevant embassy, consulate, airline, or official government authority before departure.

Moroccos.Tours is not responsible when a traveler is refused boarding or entry because of missing, invalid, or incomplete travel documents.

12. Travel Insurance

Unless expressly stated in writing, travel insurance is not included in the tour price.

We strongly recommend purchasing comprehensive travel insurance immediately after confirming your booking.

Your policy should provide suitable cover for:

  • Trip cancellation
  • Trip interruption
  • Medical treatment
  • Emergency evacuation and repatriation
  • Personal accident
  • Lost, stolen, or damaged baggage
  • Travel delay
  • Missed departure
  • Activities included in the itinerary
  • Existing medical conditions, where relevant

Some activities or suppliers may require evidence of suitable insurance before participation.

Travelers are responsible for understanding the coverage, exclusions, and claim requirements of their own insurance policy.

13. Health, Mobility, and Special Requirements

You must inform us before booking about any matter that may affect your ability to participate safely and comfortably, including:

  • Reduced mobility
  • Medical conditions
  • Allergies
  • Dietary requirements
  • Pregnancy
  • Required medication
  • Accessibility needs
  • Special room requirements

We will make reasonable efforts to communicate relevant requests to suppliers and determine whether the proposed itinerary is suitable.

A special request becomes part of the confirmed booking only when it is expressly accepted in writing.

Some medinas, historic properties, mountain routes, desert camps, and remote locations may involve:

  • Uneven ground
  • Stairs
  • Limited vehicle access
  • Long walking distances
  • Heat
  • Altitude
  • Limited medical facilities

Travelers should ask for suitability information before confirming when these conditions may affect them.

14. Children and Minors

A parent, legal guardian, or authorized adult must accompany travelers under 18 unless a different arrangement has been expressly approved in writing.

The responsible adult must ensure that minors have:

  • Appropriate travel documents
  • Required parental authorization
  • Suitable insurance
  • Appropriate supervision
  • Child seats or safety equipment requested in advance

Child seats are subject to availability and must be requested before confirmation.

15. Changes Requested by the Traveler

Requests to change a confirmed booking must be submitted in writing.

We will make reasonable efforts to accommodate the requested change, but changes remain subject to:

  • Availability
  • Supplier approval
  • Seasonal price differences
  • Administrative expenses
  • Cancellation conditions affecting the original services
  • Additional transport or accommodation costs

Examples include:

  • Changing the travel dates
  • Adding or removing travelers
  • Changing room arrangements
  • Changing the route
  • Upgrading accommodation
  • Adding activities
  • Changing the starting or ending city

A requested change becomes effective only after we confirm it in writing.

When one traveler leaves a shared booking, the price for the remaining travelers may change because accommodation, transport, or other group costs must be recalculated.

16. Cancellation by the Traveler

If you need to cancel your trip, you must notify Moroccos.Tours in writing by email or through another written communication method previously agreed with our team.

Your cancellation becomes effective on the date we receive your written notice.

Cancellation fees are calculated as a percentage of the total confirmed trip price and depend on the number of days remaining before the scheduled start of your journey.

The following cancellation fees apply:

  • 60 days or more before departure: 10% of the total trip price
  • 30 to 59 days before departure: 20% of the total trip price
  • 15 to 29 days before departure: 70% of the total trip price
  • 14 days or fewer before departure: 100% of the total trip price

A 100% cancellation fee also applies when a traveler:

  • Does not arrive for the tour
  • Cancels on the scheduled starting date
  • Misses the agreed departure without contacting us
  • Voluntarily leaves the journey after it has begun

Refunds following traveler cancellation

When a refund is due, we will calculate the refundable balance after applying the relevant cancellation fee.

We aim to process approved refunds within 14 to 30 calendar days after the cancellation and refundable amount have been confirmed.

The time required for the funds to appear in your account may vary according to:

  • Your bank
  • Your card provider
  • The payment method
  • International processing procedures

Non-returned bank fees, payment-processing charges, and currency-conversion differences may be deducted where permitted and clearly documented.

Non-refundable supplier reservations

Certain services may have stricter conditions because payment must be made in advance to a hotel, riad, desert camp, transport company, guide, airline, or activity provider.

Any separate non-refundable or partially refundable condition should be identified in the quotation or booking confirmation before payment.

The same supplier cost will not be deducted twice when it has already been covered by the percentage cancellation fee.

17. Postponing the Journey

Depending on availability and supplier conditions, we may be able to help you postpone your journey instead of cancelling it.

A postponement may involve:

  • Seasonal price differences
  • Accommodation changes
  • Supplier amendment fees
  • Changes to the route
  • A new final-payment deadline

A request to postpone does not replace or cancel the original booking until the revised arrangements have been confirmed in writing.

When the new date cannot be confirmed, the original booking and applicable cancellation conditions remain in effect.

18. Changes Made by Moroccos.Tours

Travel arrangements can occasionally require changes because of availability, road conditions, weather, government restrictions, supplier decisions, or other operational circumstances.

We may make minor changes that do not materially affect the overall journey, such as:

  • Reversing the order of visits
  • Adjusting departure times
  • Replacing a stop with a reasonable alternative
  • Changing the assigned driver or guide
  • Replacing accommodation with a comparable option

We will inform you of material changes as soon as reasonably possible.

When a significant element of the confirmed itinerary must be changed before departure, we may offer:

  • The revised arrangement
  • A reasonable alternative
  • A suitable change of date
  • A refund for the materially affected service when an acceptable alternative cannot be provided

Your mandatory legal rights remain unaffected.

19. Cancellation by Moroccos.Tours

Moroccos.Tours may cancel a booking when

  • The required payment has not been received
  • The traveler has provided materially false information
  • The traveler’s conduct creates a serious safety or legal risk
  • The services cannot be performed because of circumstances outside reasonable control
  • A material supplier failure makes the itinerary impossible, and no suitable alternative is available

When we cancel a trip for reasons within our reasonable control before it begins, we will refund amounts paid for services that will not be provided.

When cancellation results from circumstances outside our reasonable control, we will explain the available options, which may include:

  • Postponement
  • A revised itinerary
  • Supplier credit
  • A refund of amounts recoverable for unprovided services

We will not retain the value of services that have not been provided and that are fully recovered from the relevant suppliers, except for any reasonable and previously disclosed administrative costs permitted by law.

20. Events Outside Our Reasonable Control

Moroccos.Tours is not responsible for failure or delay caused by events that could not reasonably have been prevented or controlled.

These circumstances may include:

  • Extreme weather
  • Flood, earthquake, fire, or other natural disaster
  • Road closure
  • Epidemic or public-health emergency
  • Government restriction
  • Border closure
  • War, terrorism, or civil unrest
  • Strike
  • Airport or port closure
  • Airspace disruption
  • Utility or communications failure
  • Serious transport disruption
  • Supplier closure resulting from such an event

When such an event affects your journey, we will make reasonable efforts to:

  • Protect traveler safety
  • Communicate available information
  • Rearrange affected services
  • Offer reasonable alternatives
  • Recover refundable supplier payments
  • Limit avoidable additional costs

Additional accommodation, meals, transport, or other expenses caused by circumstances outside our control may be payable by the traveler unless included in the confirmed booking, covered by a supplier, or recoverable through travel insurance.

Nothing in this section excludes obligations or consumer rights that cannot lawfully be excluded.

21. Accommodation

Accommodation is provided according to the category, room type, and meal plan stated in the confirmed itinerary.

Hotel and riad classifications and room sizes and facilities may differ from those in the traveler’s home country.

Specific properties remain subject to availability until confirmed. When a confirmed property becomes unavailable, we may arrange a reasonable alternative of a comparable standard and location where possible.

Requests relating to:

  • Twin or double beds
  • Connecting rooms
  • Specific floors
  • Views
  • Early check-in
  • Late check-out
  • Accessibility
  • Dietary requirements

are subject to availability unless expressly guaranteed in writing.

Tourism taxes, porterage, minibar expenses, laundry, and other personal charges are excluded unless expressly included.

22. Transport

The type of vehicle used will depend on:

  • Group size
  • Route
  • Luggage
  • Road access
  • Availability

Private transport does not mean that the driver is automatically a licensed city guide.

Licensed guides may be arranged separately where stated in the itinerary.

Journey times are approximate and can be affected by:

  • Traffic
  • Weather
  • Road works
  • Police controls
  • Rest stops
  • Meal stops
  • Seasonal conditions
  • Events outside our control

Travelers must follow reasonable safety instructions and use seat belts where provided.

Smoking is not permitted inside the vehicle.

23. Guides

Licensed guides are arranged for the destinations and visits specified in the confirmed itinerary.

The guide’s language should be stated in the quotation or itinerary.

Guide availability may change. When a confirmed guide becomes unavailable, we will make reasonable efforts to arrange another qualified guide.

A tour driver may share practical information during the journey but should not be represented as a licensed city guide unless that person holds the required professional authorization.

24. Activities and Desert Experiences

Activities such as camel rides, trekking, quad biking, ballooning, horse riding, cooking classes, hammams, and desert transfers may involve additional conditions or safety requirements.

Travelers must:

  • Follow the provider’s safety instructions
  • Use required safety equipment
  • Disclose relevant health or mobility concerns
  • Avoid participating while impaired by alcohol or drugs
  • Ensure that their insurance covers the activity

An activity provider may refuse participation when it reasonably considers that participation would create a safety risk.

Weather-dependent activities may be delayed, modified, or cancelled. When an activity cannot operate, we will seek a reasonable alternative, rescheduling or the refund available under the provider’s terms.

25. Traveler Conduct

Travelers must behave respectfully toward:

  • Other travelers
  • Drivers
  • Guides
  • Accommodation staff
  • Local communities
  • Cultural and religious sites
  • Animals
  • Property
  • The natural environment

A traveler may be removed from an activity or itinerary when their conduct

  • Threatens safety
  • Is abusive, discriminatory, or violent
  • Causes serious disruption
  • Damages property
  • Violates applicable law
  • Repeatedly disregards reasonable instructions

When a traveler is removed for serious misconduct, Moroccos.Tours is not responsible for unused services or additional travel costs, subject to applicable law.

The traveler remains responsible for damage or loss caused intentionally or through negligent conduct.

26. Delays, Missed Arrivals, and Independent Arrangements

You must provide accurate arrival and departure information and notify us promptly of delays or changes.

When a flight, ferry, or train is delayed, we will make reasonable efforts to adjust a confirmed transfer. Additional waiting time, accommodation, or transport charges may apply when the delay is outside the services included in the booking.

Moroccos.Tours is not responsible for independently booked flights, hotels, transport, or activities that are not included in the confirmed itinerary.

We recommend allowing reasonable connection time before and after the tour.

27. Baggage and Personal Property

Travelers remain responsible for their baggage, money, passports, electronic devices, and personal belongings.

Moroccos.Tours is not responsible for loss, theft, or damage unless caused by a failure for which Moroccos.Tours is legally responsible.

Any loss should be reported immediately to:

  • The relevant supplier
  • Moroccos.Tours
  • The local police, where appropriate
  • The traveler’s insurance company

Travelers should not leave passports, cash, or valuables unattended in a vehicle or public place.

28. Problems During the Journey

If a confirmed service is missing, incorrect, or unsatisfactory, contact Moroccos.Tours as soon as possible.

Prompt notification gives us an opportunity to investigate and, where reasonably possible, correct the problem during the journey.

You should also report the issue to the relevant hotel, guide, driver, or activity provider when appropriate.

Keep anything relevant:

  • Photographs
  • Receipts
  • Messages
  • Supplier reports
  • Supporting documents

Failure to report a problem during the journey may limit our ability to investigate or provide an immediate solution, but it does not remove any mandatory legal rights.

29. Complaints

When a problem has not been resolved during the journey, send a written complaint to:

Please include:

  • Lead traveler’s name
  • Booking reference
  • Travel dates
  • Description of the issue
  • When and where it occurred
  • The people contacted during the journey
  • The resolution requested
  • Relevant supporting documents

To help us investigate efficiently, complaints should preferably be submitted within 14 days after the end of the tour. This preferred period does not remove any longer period or mandatory right available under applicable law.

We aim to acknowledge the complaint promptly and provide a substantive response after reviewing the relevant information and consulting any involved supplier.

30. Our Responsibility

Moroccos.Tours is responsible for performing the planning, reservation, and coordination obligations expressly accepted in the confirmed booking.

We will use reasonable care when selecting and coordinating independent suppliers.

Moroccos.Tours is not responsible for:

  • Services booked independently by the traveler
  • Loss arising from inaccurate information provided by the traveler
  • A traveler’s failure to obtain required documents
  • A traveler’s failure to follow reasonable instructions
  • Loss that could not reasonably have been anticipated
  • Events outside reasonable control
  • Personal purchases or arrangements not included in the booking

Nothing in these terms excludes or restricts liability for:

  • Fraud
  • Deliberate misconduct
  • Gross negligence
  • Death or personal injury caused by legally established negligence
  • Any responsibility that cannot lawfully be excluded
  • Mandatory consumer rights

31. Supplier Responsibility

Independent suppliers remain responsible for the proper performance of the services they provide.

Their services may be subject to:

  • Professional regulations
  • Safety rules
  • Local operating conditions
  • Capacity restrictions
  • Supplier-specific conditions disclosed before booking

When a supplier condition conflicts with a mandatory legal right, the mandatory legal right prevails.

Moroccos.Tours will reasonably assist the traveler in communicating a legitimate complaint relating to a supplier included in the confirmed itinerary.

32. Website Information

We make reasonable efforts to keep the website accurate and current.

However:

  • Sample itineraries may change
  • Photographs may show one example of a property or experience
  • Prices may change
  • Opening hours may change
  • Routes may be affected by seasonal or operational conditions
  • Website content may contain an occasional error

Website content does not replace the final written quotation and booking confirmation.

When the website differs from the final confirmed booking documents, the final booking documents apply.

We reserve the right to correct genuine typographical, calculation, or publishing errors. If a material pricing error is identified before confirmation, we will provide the corrected price before asking you to proceed.

33. Intellectual Property

Unless otherwise stated, website content—including text, branding, itineraries, maps, graphics, and original photographs—is owned by or licensed to Moroccos.Tours.

Content may not be copied, reproduced, republished, or used commercially without prior written permission.

Travelers retain ownership of photographs they take.

We will not use a traveler’s identifiable photograph or testimonial for marketing without the traveler’s permission.

34. Personal Information

We process personal information for purposes such as:

  • Responding to inquiries
  • Preparing quotations
  • Confirming bookings
  • Sharing required information with suppliers
  • Processing payments
  • Providing customer support
  • Meeting legal and administrative obligations

When you provide information about another traveler, you confirm that you are authorized to provide it and that the traveler has been informed about its use.

35. Notices and Written Communication

Important notices relating to a booking should be sent in writing by email or another written method previously agreed with Moroccos.Tours.

A notice is considered received when it reaches the designated communication account and can reasonably be accessed.

Travelers must ensure that the email address and telephone number provided remain active and accurate.

36. Changes to These Terms

The Terms applicable to your booking are normally those provided or available when the booking is confirmed.

We may update the website version of these Terms for future bookings to reflect:

  • Legal changes
  • Regulatory requirements
  • Business-process changes
  • Clarifications
  • New services

A later website update will not normally change the terms of an already confirmed booking unless:

  • The change is required by law
  • The change benefits the traveler
  • Both parties agree to it in writing

37. Entire Agreement

The accepted quotation, final itinerary, booking confirmation, and these Terms form the complete agreement for the confirmed services.

Informal discussions, promotional content, or preliminary proposals do not form part of the agreement unless expressly included in the final written booking documents.

38. Severability

If one provision of these Terms is found to be invalid or unenforceable, the remaining provisions will continue to apply to the extent legally possible.

The invalid provision should be interpreted or replaced in a manner that most closely reflects its lawful purpose.

39. No Waiver

If either party does not immediately enforce a right under these Terms, that does not mean the right has been waived.

A waiver is effective only when clearly confirmed in writing.

40. Governing Law and Disputes

These Terms and the booking relationship are governed by the laws of Morocco.

If a dispute arises, both parties should first attempt to resolve it through direct written communication and good-faith negotiation.

When an amicable resolution cannot be reached, the dispute may be submitted to the competent Moroccan courts, subject to any mandatory jurisdiction or consumer-protection rules that apply.

Nothing in this section removes a traveler’s right to contact an appropriate public authority, regulator or consumer-protection body.
